Terms of Service

By registering for an account, clicking "I agree," or otherwise accessing or using Apsara Talent, you confirm that you have read, understood, and agreed to be bound by these Terms of Service and our Privacy Policy, which is incorporated herein by reference.

If you are accepting these terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these terms.

To use Apsara Talent, you must:

• Be at least 18 years of age.
• Have the legal capacity to enter into a binding contract.
• Not be prohibited from using the platform under applicable law.
• Not have had a previous account terminated by Apsara Talent for violations of these terms.

By using the platform, you represent and warrant that all of the above conditions are met.

Apsara Talent offers two distinct account types:

Each user may maintain only one account per account type. Creating multiple accounts to circumvent restrictions is prohibited.

When registering an account you agree to:

• Provide accurate, current, and complete information about yourself or your company.
• Maintain and promptly update your information to keep it accurate.
• Keep your password confidential and not share it with any third party.
• Notify us immediately if you suspect unauthorised access to your account.
• Accept responsibility for all activities that occur under your account.

You may register using an email address and password, or via social login through Google, Facebook, LinkedIn, or GitHub. By using social login, you also agree to the terms of those respective providers.

You agree to use Apsara Talent only for its intended purpose of professional talent matching and for lawful purposes consistent with these terms. Specifically, you agree to:

• Keep your profile information truthful, accurate, and professional.
• Use the messaging feature only to communicate in good faith about legitimate employment or hiring opportunities.
• Respect other users' privacy and treat all parties with professionalism.
• Comply with all applicable Cambodian laws and regulations.

The following conduct is strictly prohibited on Apsara Talent:

• Impersonating another person, company, or entity.
• Posting false, misleading, or fraudulent job listings or candidate profiles.
• Harassment, discrimination, or abusive behaviour toward other users via the messaging system or any other feature.
• Sending unsolicited commercial messages (spam) through the platform.
• Scraping, crawling, or harvesting user data from the platform using automated tools.
• Attempting to reverse-engineer, decompile, or compromise the security of the platform.
• Using the platform to distribute malware, phishing content, or any other malicious material.
• Circumventing or attempting to circumvent any access controls or security features.
• Creating accounts for the purpose of manipulating search rankings or the matching algorithm.

Violations may result in immediate account suspension or permanent termination, and may be reported to relevant authorities.

You retain ownership of all content you submit to Apsara Talent, including your profile information, photos, resume, cover letter, and messages.

By submitting content, you grant Apsara Talent a worldwide, non-exclusive, royalty-free licence to store, display, and process your content solely for the purpose of operating and improving the platform. We do not claim ownership of your content.

You are solely responsible for the content you submit and represent that:

• You own the content or have the right to share it.
• The content does not infringe any third party's intellectual property, privacy, or other rights.
• The content is accurate and not misleading.

Apsara Talent provides an AI-powered Resume Builder feature designed to assist you in drafting and formatting your professional resume.

• AI-generated content is provided as a starting point and may contain errors, inaccuracies, or outdated information. You are responsible for reviewing and verifying all AI-generated content before using it.
• Do not rely solely on AI-generated content for important decisions. Always review the output critically.
• By using the AI Resume Builder, your profile data is processed by our AI systems to generate suggestions.
• Apsara Talent does not guarantee any specific outcomes (e.g. job offers) resulting from use of the Resume Builder.

All elements of the Apsara Talent platform — including the brand name, logo, software, design, code, and proprietary algorithms — are the intellectual property of Apsara Talent and are protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the platform for its intended purpose. You may not copy, modify, distribute, sell, or create derivative works from any part of the platform without our prior written consent.

Your use of Apsara Talent is also governed by our Privacy Policy, which is incorporated into these Terms of Service by reference. By using the platform, you consent to the collection and use of your information as described in the Privacy Policy.

Apsara Talent is a platform that facilitates connections between job seekers and employers. We are not a recruitment agency, staffing firm, or employer. We do not make or participate in hiring decisions.

• We do not guarantee that any job seeker will find employment, or that any company will find suitable candidates through the platform.
• We do not verify the accuracy of user-provided information, including job titles, skills, or company details. Users are encouraged to conduct their own due diligence.
• The platform is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.
• We do not guarantee uninterrupted, error-free service and reserve the right to perform maintenance that may temporarily affect availability.

To the maximum extent permitted by applicable law, Apsara Talent and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the platform, including but not limited to:

• Loss of employment opportunities or business.
• Reliance on inaccurate information provided by other users.
• Unauthorised access to your account resulting from your failure to maintain password security.
• Any conduct or content of third parties on the platform.

Our total aggregate liability to you for any claim shall not exceed the amount you paid us (if any) in the twelve months prior to the event giving rise to the claim.

By you: You may delete your account at any time through your profile settings. Upon deletion, your data will be handled as described in our Privacy Policy.

By us: We reserve the right to suspend or terminate your account at any time, with or without notice, for any of the following reasons:

• Violation of these Terms of Service.
• Fraudulent, deceptive, or harmful behaviour.
• Inactivity for an extended period.
• Legal obligation or regulatory requirement.

Upon termination, your right to access the platform immediately ceases. Provisions of these terms that by their nature should survive termination will remain in effect.

These Terms of Service shall be governed by and construed in accordance with the laws of the Kingdom of Cambodia, , without regard to conflict-of-law principles.

Any disputes arising from or relating to these terms or your use of Apsara Talent shall be subject to the exclusive jurisdiction of the competent courts of Phnom Penh, Cambodia. You waive any objection to the jurisdiction or venue of such courts.

We may modify these Terms of Service at any time. We will provide notice of material changes by updating the "Last updated" date and, where appropriate, notifying registered users by email or in-app notification.

Your continued use of Apsara Talent after the effective date of any updated terms constitutes your acceptance of those changes. If you do not agree to the updated terms, you must stop using the platform and delete your account.
